When dues are not paid as required by our Governing Documents, the HOA will inform the Homeowner that a payment was missed.If payment is not received within 30 days of first warning, then a second warning letter will be sent. The letter will also state that their Resident Gate Access will be deactivated. If payment is not received within 30 days of the second warning, a final warning letter will be sent by first-class United States mail to the owner at his or her last address as reflected in the association’s records and, if such address is not the parcel address, must also be sent by first-class United States mail to the parcel address, as per Florida Statute 720. If payment is not received within 10 days of final warning, the account will be sent to our legal staff for collections.
Governing Documents Section 6.13.3. If the assessment is not paid within thirty (30) days after the due date it shall be deemed delinquent and shall bear interest from the date of delinquency at the rate of eighteen percent (18%) per annum, and the Association may bring an action at law against the Owner personally obligated to pay the same or foreclose the lien against the property, and there shall be added to the amount of such assessment the costs of preparing and filing the complaint in such action, and in the event a judgment is obtained, such judgment shall include interest on the assessment as above provided and a reasonable attorney's fee to be fixed by the court together with the costs of the action.
